Object and purpose of contract
These General Conditions of Sale (hereinafter "General Conditions") govern distance purchasing pursuant to article 50 et seq. of Legislative Decree 6 September 2005 n.206 (online sale) of services for cleaning windows of private homes, promoted on the site managed by THE BEST CLEANINGS SERVICE S.R.L., with registered office in Via Puccini nn. 9/11, C.A.P. 20098, San Giuliano Milanese (Mi), C.F. and VAT number 05188240963 – R.E.A. 1802835.
The Best Cleanings Service s.r.l. makes available to users the Services illustrated on the homepage of the Site and/or within the various web pages of the same, which are intended for users of adult consumers residing in Italy.
For the purposes of these Conditions General, Consumer user ("Consumer") means any natural person who purchases the Services on the Site for purposes unrelated to any commercial, industrial, artisanal or professional activity carried out, in accordance with the provisions of the art. 3 of the Legislative Decree. 6 September 2005 n. 206 (the “Consumer Code”).
The Best Cleanings Service s.r.l. invites each user to carefully read these General Conditions of Sale of their services, before completing any purchase and, once this operation is concluded, to print them or save a copy in digital format.
By accessing the Site l The user accepts without reservation the conditions of use of the Site and undertakes to respect them.

Service conditions
Le seguenti condizioni si applicano ai servizi di pulizia ordinaria di vetrate di abitazioni private prescelti dall’Utente tra i Servizi offerti dalla The Best Cleanings Service s.r.l. (pacchetto “Splendid” per n. 1 intervento oppure pacchetto “Arcobaleno” per n. 5 interventi).
In summary, the Services offered by The Best Cleanings Service s.r.l., which can be purchased separately, are identified as:| ||91
“Pacchetto Splendid” – comprensivo di n. 1 intervento – che comprende n. 1 intervento (manodopera e prodotti di base) per la pulizia di n. 5 vetrate/finestre agibili dall’interno (finestre con misurazione 140 h e 250 h), di cui n°3 finestre 140h x 140 e n° 2 finestre 250 h x 150;
“Rainbow Package” – including n. 5 interventions – which includes n. 5 interventions (labour and basic products) for cleaning, each, of n. 5 glass windows/windows accessible from the inside (windows measuring 140h and 250h), of which 3 windows 140h x 140 and 2 windows 250h x 150.
Each of the Packages (Spendid Package or Package Arcobaleno) can be used no later than six months from the date of purchase (Order Confirmation); if the Customer does not agree, in the case of the Splendid Package, the no. 1 (one) intervention, or, in the case of the Rainbow Package, the n. 5 (five) interventions, within this timeframe the services can no longer be requested or reimbursed nor can they be combined with other packages purchased.
The aforementioned Services are provided from Monday to Friday from 8:00 to 6.00 pm and on Saturdays from 8.00 am to 12.00 pm, they will be delivered to the premises and/or living places indicated by the User when completing the Order.

The Best Cleanings Service s.r.l. undertakes to use suitable equipment, materials and products, guaranteeing compliance with legal regulations regarding quality and safety.
The packages do not include post-renovation and first entry cleaning.
Methods of conclusion of the sales contract and Order
The publication on the Services Site constitutes an invitation to users to formulate to The Best Cleanings Service s.r.l. a purchase proposal. Each Order sent by the Customer online integrates a contractual proposal (the "Order").
Once the Order has been received, The Best Cleanings Service s.r.l. will automatically send the Customer an e-mail/communication of "confirmation of receipt" containing the details of the Order and all the data relating to the purchase or the type of service requested and the related costs, as well as the personal data and contact details of the Customer.
All orders are, below, subject to acceptance by The Best Cleanings Service s.r.l. who will provide notification of acceptance or rejection of the Order as soon as reasonably practicable; as a rule, The Best Cleanings Service s.r.l. notifies the User about the acceptance or rejection of the request for an Order within 24 hours.
The sales contract between the Customer and The Best Cleanings Service s.r.l. will be completed only when the Customer's Order is accepted by The Best Cleanings Service s.r.l. (“Order Confirmation”).
The status of each Order can be monitored by contacting Customer Service as indicated above.
Order Cancellation
The Best Cleanings Service s.r.l. reserves the right to cancel any Purchase Order for Services, at its discretion, whether or not the Customer's credit card has been charged, in the event that a clerical error regarding the price occurred at the time of publication on the Site.
If the Order is canceled after payment has been made, The Best Cleanings Service s.r.l. will take the necessary measures to re-credit the Customer with the same amount as the amount already paid (or may contact the Customer to receive information for this purpose).
The company The Best Cleanings Service S.r.l. has the right to cancel the contract for just cause, returning the price paid by the Customer.
Prices and availability
The prices of the Services applied by The Best Cleanings Service s.r.l. are those indicated on the Site at the time the order is placed.
Before confirming the purchase to the customer, the unit cost of each chosen product and the total cost in the case of multiple products will be summarized.| ||111
I prezzi indicati sono da intendere al netto I.V.A. che, tuttavia, verrà calcolata automaticamente prima della conferma dell’Ordine. Il totale dell’Ordine, una volta acquistato il pacchetto, sarà pertanto formato dal prezzo del Servizio e dall’IVA.
The prices shown on the Site are subject to possible variations and/or modifications by The Best Cleanings Service s.r.l. without any obligation to notify the Customer. To sales contracts concluded before the publication of the aforementioned changes, but still in progress, the prices in force at the time in which The Best Cleanings Service s.r.l. will receive the Customer's Order.
Payment and Billing Methods
Customers will be able to make payments for purchases by credit card, with the PayPal system and by bank transfer.
At the time of compilation of the Order, the Customer is required to indicate the chosen payment method.
The Best Cleanings Service s.r.l. reserves the right to develop its own systems to allow additional payment methods for its future Customers.
The Best Cleanings Service s.r.l. uses secure payment protocols to safeguard the privacy of the Customers.
If the Customer decides to proceed with the purchase of the Services with payment of the price by credit card or PayPal, the payment of the total amount due for the Contract must be carried out when the Order is placed using one of the credit cards.
If the Customer decides to make the payment via Bank Transfer, he will have five days available from the date of sending the Order to make the payment. After five days, the Order will be considered canceled by the Seller. In the case of a bank transfer, we will therefore proceed once the credit has been received.
Invoices can be sent by email in PDF format to the email address provided on the Order, or by post in paper format (the option must be selected when placing the Order).
Right of withdrawal
The Consumer Customer has the right to withdraw from the sales contract without any penalty and without specifying the reason at any time within 14 days (calendar) starting from the date of confirmation of the Order ("Withdrawal Period").
To exercise the right of withdrawal you must send a registered letter with return receipt and preferably also an e-mail to info@cleaningsservice.it or a fax to no. 02.98247082.
The communication relating to the exercise of the right of withdrawal must be sent by the Consumer before the expiry of the Withdrawal Period; you are invited to indicate in the Declaration of Withdrawal the Order number, the Service(s) for which you intend to exercise the right of withdrawal and your address.
The Best Cleanings Service s.r.l. will reimburse the Consumer for the entire amount paid for the Services referred to in the sales contract subject to withdrawal. The refund will take place using the credit card data provided by the Consumer at the time of placing the Order, or by bank transfer to the coordinates indicated by the Consumer himself.
The right of withdrawal is excluded in the case in which the contract has been completely executed by both parties, or even only by the professional, at the express request of the Consumer before the latter has exercised his right of cancellation.
Execution of Services
The Services will be performed at the address indicated by the Customer at the time of the Order.
The company will offer the services at the price shown on the site only for services to be performed within 15 km away from its registered office. In the event that the premises where the work will be carried out are located at a distance greater than 15 km, a price increase will be applied and communicated to the buyer by telephone or e-mail. In any case, the company reserves the right not to accept orders that involve excessively burdensome travel in terms of distance, travel times and location of the premises.
The various interventions and/or services offered by the company will be agreed and scheduled via e-mail in compliance with the Customer's needs.
The cleaning contract is considered concluded once the purchased services have been carried out.
Duties/duties of the Customer
The User is required to provide The Best Cleanings Service s.r.l. the information and assistance necessary for the execution of the contract, in order to ensure that the work can be carried out perfectly and efficiently. It must ensure that all requirements for the provision of the service are met at the agreed time. This applies in particular with regard to the guarantee of access to the place where the service must be performed.
The customer, whose apartment must necessarily be equipped with water and electricity, undertakes to put a three-step ladder is available to the company to ensure availability at the start of the service.
The Customer will have the burden of communicating in writing any cancellations of the service and/or any changes to the agreed intervention date in a timely manner and in any case no later than 48 hours prior to the agreed date, otherwise the intervention will be considered as having been carried out. Specifically:
– in the case of the Spendid Package (including 1 intervention), the company will have the right to retain the entire sum paid by the Customer at the time of purchase and will not provide any refund or to organize a new intervention/a new outing;
– in the case of the Rainbow Package (including 5 interventions), the company will have the right to charge for the intervention which, therefore, will not be refunded and will be deducted from the remaining interventions included in the Packages. No new outing will be organized to re-manage and replace the intervention not promptly cancelled.
The same conditions will be applied in the event that the operators of the company The Best Cleanings Service S.r.l. cannot access the premises on the day of the intervention for any reason and/or cause not attributable to them, such as, for example, the non-presence of the customer at the site of the intervention with consequent inability of the company to carry out the scheduled intervention; the intervention will be charged in full and the exit already scheduled will not be re-managed.
Limitations of liability
The responsibility of The Best Cleanings Service s.r.l. for damages arising from this Sales Contract is limited to the emerging damage and cannot exceed an amount equal to the greater sum between €2,000,000.00, or the maximum amount resulting from the insurance policy active at the time of the accident, and the value of the consideration of the Order from which the harmful event originated.
In no case will one party be liable towards the other for indirect damages, whether attributable to lost profits, loss of opportunities, unavailability of systems, loss or damage of data, or other. This clause defines the maximum liability of The Best Cleanings Service s.r.l. in compliance with the limits permissible under the law applicable to the individual Order.
For Consumer buyers, no clause in these General Conditions may limit or exclude the Seller's liability for a breach which is the responsibility of The Best Cleanings Service s.r.l.
The Best Cleanings Service s.r.l. declines all responsibility for any delay and/or interruption and/or impossibility of performance of the Service if such delay or lack of performance is attributable to causes beyond its reasonable control such as, by way of example, but not limited to: actions of strike by third parties, terrorism, war, natural disasters, adverse weather, injury or illness of the professional (Force majeure); in such cases, The Best Cleanings Service s.r.l. may agree with the User on a later time at which to terminate or perform the Service. If it is not possible to re-schedule the Service by the User, the Order will be considered terminated due to supervening impossibility, without The Best Cleanings Service s.r.l. is bound to something else towards the User, as regards that specific Order, and without any compensation due.
Furthermore, The Best Cleanings Service s.r.l. may terminate this Contract with the User if the User is in default of obligations of considerable importance, such as to undermine confidence in the accuracy of subsequent obligations.
During the intervention, the company The Best Cleanings Service S.r.l. does not assume any obligation and/or responsibility for the care and/or supervision of animals, children or any other person present on site.
Communications and Complaints
All communications or any complaints against The Best Cleanings Service s.r.l. they must be addressed to Customer Service on the telephone number 02.98245619 between the hours of 8.30-12.30 and 15.00-18.00 from Monday to Friday or by sending an e-mail to info@cleaningsservice.it.
Modification of the contract
The Best Cleanings Service s.r.l. may modify, without notice, the General Conditions. Such changes will be effective from the day of their publication on the Site. Purchase orders sent to The Best Cleanings Service s.r.l. before the publication of the aforementioned changes, the General Conditions in force at the time of conclusion of the sales contract will be applied.
Processing of personal data
By signing this agreement, the parties mutually acknowledge and confirm that any processing of personal data deriving from the execution of this contract is provided for by Legislative Decree no. . 196/2003 and subsequent amendments and by European Regulation 679/2016 (G.D.P.R.).
Applicable law, jurisdiction and competent court
These General Conditions are governed by Italian law as well as each Sales Contract is subject to Italian jurisdiction.
For anything not provided for in this contract, the parties refer to the provisions of the civil code, as applicable.
The Court of Milan will be competent for all disputes.
Unfair Clauses
Pursuant to and for the purposes of articles 1341 and 1342 of the Civil Code. the Customer declares to have read, understood and intends to accept the following clauses whose title is given by way of example only: art.3 (Methods of conclusion of the Sales Contract and Order), 4 (Cancellation of the Order), 5 (Prices and Availability), 6. (Payment and Billing Methods), 7 (Right of Withdrawal), 8 (Execution of services), 9 (Customer charges/duties), 10 (Limitations of liability), 11 (Communications and Complaints), 12 (Modification of the contract), 14 (Applicable law, jurisdiction and competent court).
